Terms of Service

These terms govern your use of Wishyours. By signing in, creating a page, or making a purchase, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the service. You must be an adult to use Wishyours.

The service

Wishyours lets you create birthday pages and gifts. The Free tier is a shareable page; the Wish tier adds a reveal book with voice notes, music, and group wishes; the Surprise tier is a custom, fully-built website on your own web address, set up together with us.

Accounts

Some features need a Google account. You’re responsible for activity under your account and for keeping any reveal PINs you set safe.

Payments & refunds

Paid tiers are one-time payments processed securely by Gumroad, our Merchant of Record (the seller of record for your purchase). Each payment creates one page or order. Because each Surprise is hand-built for you, refunds are handled case by case; if something’s wrong, contact us within a reasonable time at wishyourssuprise@gmail.com and we’ll make it right where we can.

Acceptable use

You agree not to use Wishyours to create or upload content that:

• is unlawful, hateful, harassing, or infringes someone’s rights;
• you don’t own or have permission to use (including photos and music);
• impersonates someone, or violates their privacy.

We may remove content or suspend access that breaks these rules, especially messages or voice notes left by others through a shared link.

Your content & permissions

You keep ownership of everything you add. You grant us the limited licence needed only to store, display, and (for Surprise orders) build the page or website you asked for, and for nothing else. You confirm that you have the right and the permission to share everything you upload, including the photos, voice notes, and details of the birthday person and of anyone who signs the book. If you can’t confirm that, please don’t upload it.

Surprise orders

For Surprise orders we aim to deliver the finished website to your given contact promptly, typically within about an hour, though this is a best-effort target and not a guarantee. Where a custom domain is involved, we may purchase and connect it on your behalf using the details you provide; please make sure they’re accurate.

Intellectual property

The Wishyours name, brand, and software are ours. These terms don’t give you any rights to them beyond using the service as intended.

Disclaimers & liability

The service is provided “as is”. To the extent permitted by law, we’re not liable for indirect or incidental losses, and our total liability for any claim is limited to what you paid us for the relevant page or order.

Data & privacy

How we handle your information is described in our Privacy Policy. By using Wishyours you consent to that processing, including our team accessing an order’s content where it’s needed to build and deliver a Surprise, to moderate content, to keep users safe, or to comply with the law. We do not sell your data or use your content to train AI.

Governing law

These terms are governed by the applicable laws of the place where the service is operated and where you use it. You agree to use Wishyours in compliance with all laws that apply to you.
